PERSONAL DATA PROTECTION POLICY

Our e-shop: https://emarlenka.cz/, MARLENKA shop s.r.o., registered office: No. 230, 739 55 Smilovice, business ID number: 06213359, clearly and openly communicates how it processes your personal data in accordance with REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, the General Data Protection Regulation (hereinafter the “GDPR”).

We respect your right to privacy. In the interest of transparency, this policy provides detailed information about what personal data we process, for what purpose, for how long, to whom we transfer it, what rights you have and much more.

1. Personal data protection is our priority in everything we do. 

Your trust is important to us. We respect your control over your personal data and digital content and it is our priority to prevent any unauthorized access to it. Whenever we ask for information, we need it, we do not ask for additional information. We use a double opt-in function to verify your e-mail address.

What personal data do we require from you?

We collect personal data that you provide to us, such as when you order something, contact us or provide a review of a purchase or goods. The personal data you provide to us include both mandatory data (contact information and payment data) and optional data. You cannot shop with us without providing mandatory data. You voluntarily provide us with personal data where we ask for your consent, e.g. for registration, for sending newsletters, advice, discussions, reviews and more, to the extent specified therein.

How do we use your personal data? 
For example, we need your data for the following purposes:

to create and manage your personal account (registration);
to process your orders, deliver goods, handle returns and complaints;
to send updates on the status of your order by text message;
to contact you in case of problems with the delivery of goods you have ordered;
to answer your questions and inform you about new and changed services;
to send you commercial communications about current promotions and discounts (newsletters);
to manage your account and check your payment history;
to perform analyses to provide you with the relevant goods;
to check your age due to legal regulations on online shopping;
to send you satisfaction questionnaires with the aim of giving you the opportunity to influence our range and services;
to test and improve the systems through which we provide our services;
to prevent abuse of our services.
We will retain your personal data for as long as necessary, in particular for the purposes set out above:

·       for purchases with or without registration for a period of three years, with a new three-year period starting from the date of the last order;

·       for evaluation of purchases or goods for three years;

·       for sending commercial communications without a purchase, discussions, the watchdog, the contact form, advice, product inquiries, etc. for one year;

·       or for the statutory period (for 11 years, the data stated on a tax document, compliance with a legal duty pursuant to Act No. 235/2004 Coll., on value added tax, as amended).

After that, your personal data will be erased, unless you agree to extend the processing of your personal data.

2. We will protect you

We will improve our services. We have taken technical and organizational measures to protect your data from loss, alteration and unauthorized access. We constantly adapt our security measures in line with technological progress and developments. To make card payments as secure as possible with us, all information is sent in encrypted form using SSL. This means that the information passes through a secure connection and your payment card data cannot be read by external parties. When paying by card, we work with an authorized payment agent to help us verify that the card is valid for purchases directly with your bank. We do this through our services and by sharing information with you. The data we collect from you is only stored in the European Union.

3. You decide how much you share with us

To provide you with an even better service and relevant news, we collect information about how our apps are used. This means that when you use our website, we find out what features are most frequently used and what actions trigger error messages. However, if you do not like tracking, you can turn on incognito mode or change cookie settings on your browser. 4. We choose service providers we can trust

We are part of an internet community in which we cannot operate without external providers. The data we collect may be disclosed to the following processors:

We never provide, sell or exchange your data with third parties for business purposes.

5. What are your rights? 

You have the right to request information about what personal data we hold about you (free of charge once a year). If this information is incorrect or incomplete, you can request that we rectify or erase the information. We cannot erase your data if we are prevented from doing so by statutory regulations on retention, such as the Accounting Act or by other legitimate reasons, such as unsettled debts. You have the right to rescind your consent to the processing of your personal data (Article 7(3) of the GDPR), the right to request access to your personal data (Article 15 of the GDPR), the right to their rectification (Article 16 of the GDPR) or erasure (Article 17 of the GDPR), the right to restrict processing (Article 18 of the GDPR) and object to processing (Article 21 of the GDPR), the right to have the data transferred to another controller (Article 20 of the GDPR) and the right to make a complaint to the Office for Personal Data Protection, if you consider that our company is in breach of the GDPR when processing personal data (Article 77 of the GDPR).
